NOISE South Dublin is an affiliate project of South Dublin County Council.
1.1 I do not need to register to view the content of this site. Membership is restricted to those between the ages of 13 and 25 years old. Any exceptions to this must by approved by the Arts Office at South Dublin County Council.
1.2 I understand that prior to submission I must provide the consent of a parent or guardian of any young people under the age of 18 years old who may be featured in visual images I submit to the NOISE site, such as film or photography.
1.3 NOISE South Dublin and South Dublin County Council do not guarantee publication of submissions.
2.1 Collection
South Dublin County Council and NOISE South Dublin collect Data when I: register as a member; update my member profile; upload new material onto the site; make a complaint or enquiry or provide other feedback to them; submit an entry to a competition or prize draw; or when I disclose my data to them or otherwise through the Site at any other point.
2.2 Usage
2.2.1 My Data is used to: Monitor, develop and improve the site, services and my experience; Process my registration as a Member and to administer my Membership (where appropriate); Process and deal with any complaints or enquiries made by or about me; Investigate any suspected breach of the Terms and Conditions made by or otherwise relating to me and to monitor compliance; Where (and only where) requested by you, to send me and keep me updated with information by email or via the site directly about existing and new services and offers from them; If the site contains a competition and I am a prize winner, to publish or otherwise make available a list of prize winners.
2.2.2 My Data will only be passed on to other parties as follows: Where relevant, my Screen Name and, in some circumstances, information I voluntarily provide will be published on the Members' area of the site and this will be the identity by which I am known on the site; To NOISE South Dublin and South Dublin County Council subcontractors, employees, agents and advisors to administer my membership and the services provided to me by them now or in the future; They may disclose my data to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence or suspected breach of the site's Terms and Conditions by me or otherwise where required by law. They will not pass or sell your Data to third persons for any other purpose other than those set out above.
2.2.3 Data Security: All data collected by Noise South Dublin County is stored on a secure server.
2.2.4 Transfer of Data: This site is accessible via the Internet and I understand that the data is viewable by those accessing the Internet outside of South Dublin County and Ireland.
I agree that:
3.1 All information and details provided by me to NOISE South Dublin and South Dublin County Council is accurate, true and up to date in all respects and at all times.
3.2 I will at all times comply with these Terms & Conditions
3.3 In addition, I agree to indemnify South Dublin County Council from any claim, expenses, costs or damages (including any legal fees in relation to the same) made by any third party in respect of any matter in relation to or arising from my use and/or membership of the site arising from any breach or suspected breach of these Terms and Conditions by me or my violation of any law or the rights of any third party.
3.4 I agree to indemnify and keep indemnified Noise South Dublin and South Dublin County Council from and against all claims, damages, expenses, costs and liabilities arising in any manner from my entry to and use of the site other than in accordance with these Terms & Conditions.
4.1 The use of this site is only for lawful purposes, in a manner which does not improperly infringe the rights of, or restrict or inhibit the use and enjoyment of, this site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress or inconvenience to any person or the transmission of any obscene, racist or offensive content or interruption of the normal flow of dialogue within this site.
4.2 South Dublin County Council may exercise control over the content of the website within the terms of this agreement, removing certain content or disable access to content that appears to be legally or otherwise problematic, or for any other reason Noise South Dublin decides.
4.3 Where content that is user generated is posted onto the site and uploaded under a Creative Commons License or other shareware, authors hereby consent to Noise South Dublin editing such content in any way it deems appropriate for whatever reason. In all other respects the Creative Commons License remains unaltered
The following violations are grounds for immediate suspension of Service that will result in termination of membership accounts(s):
5.1 The posting and transmitting of any unlawful, threatening, abusive, defamatory, obscene material onto the site, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any local, state, national or international law;
5.2.1 The posting or transmitting of any information or software which contains harmful components included but not limited to: software viruses of any kind, self-replicating programs that might cause harmful interference for User's and/or Company's hardware and/or software;
5.2.2 The uploading, posting, publishing, transmitting, reproducing, or distributing in any way of information, software or other material obtained through the Service which is protected by copyright, or any other proprietary right, or derivative works with respect thereto, without obtaining permission of the copyright owner or the owner of any proprietary right.
6.1 Copyright in all artworks submitted to NOISE South Dublin County remains with the Artist. NOISE South Dublin or South Dublin County Council is granted a non-exclusive right in perpetuity to utilise your submission in whole or in part for NOISE South Dublin. Any information provided through Noise South Dublin County may be reused in other Noise South Dublin County, Arts Office and South Dublin County Council promotions and publications. For example; events published and promoted through a South Dublin Event guide on the South Dublin County Council homepage or a leaflet. Every effort will be made to refernce the source of data.
6.2 If I believe that any of my rights have been violated by material available on the Noise South Dublin site, I may submit the details of my grievance Noise South Dublin or South Dublin County Council with the following information immediately:
* The nature of your complaint and an exact description of where the material about which you complain is located within the site;
* Your electronic or physical signature.
7.1.1. NOISE South Dublin or South Dublin County Council retains sole discretion to publish submissions on its website and elsewhere in the media. Not all works submitted to NOISE South Dublin County will be published.
7.1.2 While receipt of submissions will be acknowledged, those whose work has been selected for publication will be notified.
7.1.3 On-line submissions for PROJECTS will be reviewed by NOISE South Dublin or South Dublin County Council prior to being published on the website.
8.1 Noise South Dublin nor South Dublin County Council does not endorse or accept any responsibility or liability for the content, services or information available on third party websites accessed via Noise South Dublin. If you decide to visit any linked site, you do so at your own risk. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the relevant provider of the service. Noise South Dublin County is not responsible for the data policies, content or security of these linked web sites.
8.2.1 It is my responsibility to take all protective measures to guard against viruses or other destructive elements.
8.2.2 Linked websites are not authorised to use any trademark, trade name, logo or copyright symbol of Noise South Dublin, South Dublin County Council or any of its affiliates or subsidiaries. Noise Dublin and Noise South Dublin are trademarks of South Dublin County Council.
8.2.3 Links to this website must be direct to any complete content page (and not any part of a page) within Noise South Dublin and must not be viewed within the pages of any other site.
9.1 Whilst every effort has been made to ensure the accuracy of the information and material contained on the NOISE South Dublin website, Noise South Dublin nor South Dublin County Council does not warrant or accept any liability for the accuracy or completeness of the information and materials or the reliability of any statement or other information displayed or distributed through the site (including, without limitation, the information provided through the use of any software).
9.2 Noise South Dublin no South Dublin County Council does not accept any liability for any damages including, but not limited to, indirect or consequential damages or any damages including, but not limited to, errors or omissions, indirect or consequential damages or any damages whatsoever arising from the use, loss of use, or any data or profits, whether in action of contract, negligence or other action, arising out of or in connection with the use of the site.

Noise South Dublin nor South Dublin County Council does not guarantee the full functionality, accuracy or reliability of any material. Noise South Dublin may terminate, change, suspend or discontinue any aspect of this site, including the availability of any features of the site, at any time without notice or liability.

9.6 I am aware that any of my data or other information which I disclose to another Member may then be disclosed on the site by that Member. Noise South Dublin or South Dublin County Council accepts no responsibility or control over the contents of communications made between Members.
10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Disputes arising from here shall be exclusively subject to the jurisdiction of the courts of Ireland.
10.2 If any of these Terms & Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms & Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.
10.3 Information placed on the server for public use may only be used for lawful purposes. Transmission of any material in violation of any Irish or International Law regulation is prohibited. This includes, but is not limited to material in breech of copyright or trade secret or material judged to be threatening, racist or obscene. If you access this site from a jurisdiction (location) outside of Ireland, you are responsible for compliance with all laws of that particular jurisdiction (location).
